Hatch Coding (in Canada) and Hatch America (in the United States) is provided by K Network Consulting, thus forth referred to as Hatch Coding (also "Hatch," "our" or "us", and “we”). This Privacy Policy describes how we collect, store, protect, use and distribute personal information that is collected through our website www.hatchcoding.com, as well as the provision of our software-as-a-service Platform and Hatch Subscription, as those terms are defined in our Terms of Service (collectively, the “Services”).

Any capitalized terms not defined in this Privacy Policy are defined in the Hatch Terms of Service by reference. The use of our services constitutes your agreement to the Hatch Terms of Service and to this Privacy policy.

Hatch Coding is committed to the protection and privacy of all of our users’ Personal Information (as that term is defined below). We believe in giving you full disclosure about the kinds of information we gather and what we do with it.

Consent: By using the Website or our Services you consent to the use of your Personal Information as described in this Privacy Policy.  Except as set forth in this Privacy Policy, your Personal Information and the Personal Information of Students will not be used for any other purpose without your consent. We will not actively collect Personal Information for the purpose of sale or marketing in a way that specifically identifies the individual: in other words, we don’t sell customer lists. You may withdraw your consent to our processing of your Personal Information at any time. However, withdrawing consent may result in your inability to continue using the Platform and/or otherwise accessing and using the Services, including the Hatch Subscription.

Collection of Information: We aim to collect, use and disclose only such Personal Information as is required to enable us to manage your account, to provide the Services and the Hatch Subscription, to maintain our customer/visitor/Student lists, to respond to your inquiries or provide feedback, for identification and authentication purposes, and for Website and Services improvement, including improvements to the Hatch Subscription. We will maintain the confidentiality of any contact information you provide to us on signing up for our Services, registering a Student for a Hatch Course, creating a Student account, or contacting us with questions or for further information and we will use it only for the purposes for which we have collected it (subject to the exclusions and disclosures we have listed below), unless you agree that we may disclose it to other third parties.

Two types of information may be collected through the Website and our Services: Personal Information and Non-Personal Information. This Privacy Policy does not extend to the collection, use or disclosure of the following information which is currently not limited by applicable privacy laws, including Non-Personal Information (as defined further below).

Overview

These following principles guide our decisions regarding the privacy of all the users of our Services:

  • Hatch Coding collects, stores and distributes Personal Information for the purposes of providing our Services as authorized by the consenting individual.
  • Hatch Coding will never sell, disclose, or use Student Personal Information for content for marketing or advertising purposes, except with explicit parental consent.
  • Hatch Coding will not use Student Personal Information for targeted advertising.
  • Hatch Coding does use Sponsor Personal Information for targeted advertising.
  • Hatch Coding will delete Personal Information at the direction of the consenting party in accordance with our Data Retention Policy (Section 10 of this document).
  • Hatch Coding will obtain consent for the use of our Services from the parent, guardian, or consenting party for children under the age of 13.

“You” or “your” means a User of the Services. A “User” as used in these Terms may be a “Student”, a “Sponsor”, a “Coach”, a “Teacher”, a “School Admin”, or a “District Admin”. The term “User(s)” as used herein will refer to all Users of the Services identified above (“Student”, “Sponsor”, “Coach”, “Teacher”, “Principal”, and “District Admin”).

A “Student” is any User that uses our website, registered by a “Sponsor”, a “Teacher”, a “Principal”, or a “District Admin”. A “Sponsor” is any parent, legal guardian, or other entity that registers a Student or Students to the Services at a Hatch learning centre. A “Coach” is a Hatch learning centre employee. A “Teacher” is an employee of a school, school board, or school district. A “School Admin” is the person who oversees a school implementation of Hatch. A “District Admin” is the employee of a school board or school district overseeing the use and implementation of our Services in accordance with the agreement struck (the “Contract”) with Hatch.


  • What is Personal Information?

Personal Information is any information about an identifiable individual, such as your full name, address, e-mail address, payment information, birth date, and sex. Student names, ages, and in certain cases, usernames, may also contain Personal Information. Personal Information does not include aggregate information that is not capable of being linked to an identifiable individual. At the time of collection, we will clearly identify the information being collected and the purposes for which it will be used. It is always your choice whether or not to provide Personal Information but if you choose not to provide certain requested Personal Information, in some instances you may not be able to register to use the Services or be able to access and use the Services at all.  In other instances, your choice not to provide certain other Personal Information may mean that you will not be able to use certain features of the Website. We may collect Personal Information in respect of the Website through registration processes; use of the Services, in the course of Student participation in Hatch Subscription, communications with Sponsors, Teachers, Principals, and District Admins; information downloads; Services purchases; user support; and feedback surveys.


  • What is Non-Personal Information?

Non-Personal Information is information of an anonymous nature that is not linked to an identifiable individual, and may include the domain used to access the Website, and the type and version of browser or operating system being used by visitors to the website. It also includes anonymized, aggregate information: data that we collect about a group or category of products, services or users, from which individual user identities have been removed. Aggregate information, such as demographic statistics of our users (e.g. average age or geographical allocation of our users), number of visitors, what pages users/Students access or visit, and average time spent on the Website or Platform is not considered Personal Information. Consequently, information about how you use a service may be collected and combined with information about how others use the same service. Aggregate data helps us understand trends and our users’ needs so that we can better consider new features or otherwise tailor our Services. Under some jurisdictions, business contact information such as the name, title, business address, e-mail address, or the telephone number of a business or professional person or an employee of an organization is not considered Personal Information.

Although the use of certain Non-Personal Information collected, used or disclosed through the Internet as described herein is not restricted (and to the extent that such is the case, the obligations under this Privacy Policy do not apply to such information), we provide information in this Privacy Policy about the collection of such information for the sake of transparency with respect to the operation of the Website. Such Non-Personal Information is collected or derived by us in the course of operating this Website. For example, our web servers may automatically collect Non-Personal Information that is provided through your browser or stored in a cookie when you choose to visit the Website.


  • How we collect Information about You

We collect Personal Information from the users of our Services in a number of ways.


  • Website Registration for Services at a Hatch learning centre

We collect your Personal Information through our registration process for our Hatch Course wherein Sponsors may enter their full name, address, phone number, e-mail address, and credit card information. In addition, Sponsors must provide Student information including name, current school, and birth year. In general, none of your account registration information will be shared with any other users of the Website or our Services, with the exception of designated Hatch employees.


  • Software as a Service (SaaS): School, Board, or District Registration

We collect your Personal Information through our registration process for our Platform wherein Teachers, School Admins, or District Admins may enter their full name, address, phone number, e-mail address, and credit card information. In addition, Teachers, School Admins, or District Admins—whomever is authorized to do so in the subscription agreement (Order Form) for the Hatch Platform, must provide agreed upon Student information. In general, none of your account registration information will be shared with any other users of the Website or our Services, with the exception of designated Hatch employees.

  • Cookies and System Logs

Cookies are used by us to track content usage and traffic on the Website. A cookie is a feature of your web browser that consists of a text file that is placed on your hard disk by a web server. The Website uses cookies to help it compile aggregate statistics about usage of this Website, such as how many users visit the Website, how long users spend viewing the Website, and what pages are viewed most often. This information is used to improve the content of the Website, Services and the Hatch Subscription. If you disable cookies, you may not be able to take advantage of all the features of the Website. We do not link any of the information we use in cookies to any personally identifiable information submitted by you when you are on the Website.

Your IP address is reported by your web browser whenever you visit a page on the Website. This information is recorded together with your registration information on our databases.

If we plan to use your Personal Information in future for any other purposes not identified above, we will only do so after informing you by updating this Privacy Policy. See further the section of this Privacy Policy entitled ‘Updates of this Policy’.


  • Payment Information

You must pay for the Hatch Subscription and Platform subscription on the terms set forth on the Website and in the Terms of Service, as well as any applicable Order Form. Individuals may pay by valid credit card or by cheque. Individuals may pay by valid credit card by submitting credit card information to our merchant account gateway, which is provided and hosted by Stripe—our third party payment system. Payment information such as a credit card number, full name, CSV, expiration date, and relevant payment information are securely stored by Stripe. All payment information is sent securely to Stripe and not directly stored in our Hatch database. If you are a school, school board, or school district paying for the Services, you can pay by cheque or credit card after you have received an invoice from Hatch. We do not process, hold or store any credit card or payment information, except to the extent that we receive and process cheques from individuals, schools, school boards, or school districts who pay for the Services by cheque.

Hatch does maintain records of the payments, refunds, and subscriptions tied to the associated Sponsor to maintain our payment records. All payment, refund, and subscription information stored on our Hatch databases does not contain any credit card information and is linked only with the Sponsor’s registered email and full name. The method of payment is also stored as well—be it cheque, credit, or cash payments.


  • How we use Personal Information about You

We use the information we collect for a variety of purposes, and how we use it depends on what we collect and what Services (or features of the Services) you use. These purposes may include:

  • To provide our Services
  • Providing customer support or technical assistance
  • Creating, managing, and identifying Sponsor, Teacher, School Admin, District Admin, or Student accounts
  • Contacting and communicating with Sponsors, Teachers, School Admins, or District Admins to ensure Student safety or to coordinate a program or Services
  • Marking and Grading Student work and projects
  • Marketing our services to Sponsors, Teachers, School Admins, or District Admins
  • Communicating about our Services
  • Improving our Services by using aggregate information of our users


As at the date of this Privacy Policy, we share Personal Information about you in respect of the Website only with our agents and partners, such as our analytics provider, website hosting and cloud service providers, marketing service providers, and payment processors. Our servers are also located in the United States and accordingly your Personal Information may be available to both Canadian and U.S. governments or their agencies under a lawful order, irrespective of the safeguards we have put in place for the protection of your Personal Information.

From time to time we may employ third parties to help us improve the Website and/or the Services. These third parties may have limited access to databases of user information solely for the purpose of helping us to improve the Website and/or the Services and they will be subject to contractual restrictions prohibiting them from using the information about our members for any other purpose.


  • How we share Personal Information about you

If your account is managed for you by an organization administrator, then your organization's administrator will have access to certain information (including your email and other Personal Information) in order to:

  • View statistics regarding your account;
  • Change your account password;
  • Suspend or terminate your account access;
  • Access or retain information stored as part of your account;
  • Receive your account information in order to satisfy applicable law, regulation, legal process or enforceable governmental request;
  • Restrict your ability to delete or edit information.

Important Exceptions:

We may disclose your Personal Information to third parties without your consent if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other Website members, other users of the Services, or anyone else (including the rights or property of anyone else) that could be harmed by such activities. We may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law.

We may share your information with other companies under common ownership or control with Hatch.

If Hatch is involved in a merger, acquisition or asset sale, Hatch may disclose Personal Information to an acquiring entity in accordance with applicable privacy laws. Personal Information may be governed by the acquiring entity after the transaction is complete.


  • Targeted Marketing

As a Hatch Sponsor, we rely on express or implied consent to send you marketing communications from us, we will keep you up to date on our products and services, including new Hatch Course offerings and dates. You may withdraw your consent to receiving marketing communications from us at any time by following the opt-out instructions in each communication, or by contacting us at support@hatchcoding.com. Hatch does not and will never advertise to the Student user’s of our Platform.


  • Consent and Privacy of the Child

Hatch Coding does not knowingly collect Personal Information through our Services from a child who is under 13 unless and until a Sponsor or a Teacher has given appropriate consent and authorization for a student under 13 to use the Service and for Hatch to collect information from that student. Please contact us at support@hatchcoding.com if you believe we have inadvertently collected Personal Information from a child under 13 without proper consent so that we may delete such information as soon as possible.


  • How we Store and Secure your Data

The security of your Personal Information is important to us. We will always employ reasonable efforts to store and maintain your Personal Information in a secure environment. We take technical, contractual, administrative, and physical security steps designed to protect Personal Information that you provide to us. We have implemented procedures designed to limit the dissemination of your Personal Information to only such designated staff as are reasonably necessary to carry out the stated purposes we have communicated to you.


  • What we do with your Data after Hatch

Hatch will maintain your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. Generally, we will retain registration information and student records for 10 years after completion of the course, after which time the records will be deleted.

We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law.

Hatch maintains this data to ensure that returning customers are maintained within our system. If you request that your personal information be removed from our databases, it may not be possible to completely delete all your Personal Information due to legal constraints. If you would like to request your Personal Information or have any questions about your personal information concerning its removal, contact us at privacy@hatchcoding.com.


  • Access and Accuracy of your Personal Information

To access the Personal Information we hold about you you must send a written request and we will provide you with a copy of your Personal Information although in certain limited circumstances, we may not be able to make all relevant information available to you such as where that information also pertains to another user. In such circumstances we will provide reasons for the denial to you upon request. We will endeavour to deal with all requests for access and modifications in a timely manner.

We will make every reasonable effort to keep your Personal Information accurate and up-to-date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your information. Having accurate Personal Information about you enables us to give you the best possible service.


  • Updates on our Privacy Policy

We reserve the right to change this Privacy Policy at any time. If we decide to change this Privacy Policy in the future, we will post an appropriate notice on the home page at www.hatchcoding.com. Any non-material change (such as clarifications) to this Privacy Policy will become effective on the date the change is posted and any material changes will become effective 30 days from their posting on the Website. Unless stated otherwise, our current Privacy Policy applies to all Personal Information that we have about you. We recommend that you print a copy of this Privacy Policy for your reference and revisit this policy from time to time to ensure you are aware of any changes. Your continued use of the Website signifies your acceptance of any changes.

If you have any complaints relating to the management of your Personal Information or if you believe there has been a breach of the applicable privacy laws by Hatch, please forward your complaint in writing to our Privacy Officer at the address or email address below.

Our Privacy Officer will consider the complaint and advise you of their decision in writing within a reasonable time from receipt of the complaint. If our Privacy Officer decides that there has been a breach of the applicable privacy laws, s/he will endeavour to ensure that the breach is rectified within 30 days from the date of the decision and will update you in writing.
